By continuing this electronic Bill Payment registration you are agreeing to the terms and conditions in this Online Banking Bill Payment Services Agreement and Disclosure. Please read this disclosure carefully and print it for your records. This page will not appear again. A copy of this Agreement can be printed by using your browser's print command and a printer. If you are unable to print this document, a copy can be provided to you by the Credit Union upon request.

This Online Banking Bill Payment Services Agreement and Disclosure as amended from time to time, the ("Agreement"), sets forth the terms and conditions governing the use of SunWest Federal Credit Union's Internet Bill Payment Service. Disclosure information that pertains to Bill Payment services offered by SunWest Federal Credit Union is provided below. Please read this Agreement in its entirety and retain it with your personal records. By using, or allowing another person to use, Online Banking Bill Payment services offered by SunWest Federal Credit Union, you are agreeing to be bound by the terms and conditions of this Agreement. In this Agreement, the terms "you" and "your(s)" refer to the member, and the terms "we", "us", "our(s)" and "Credit Union" refer to SunWest Federal Credit Union. All agreements and disclosures shall be construed in accordance with the provisions of the Arizona Uniform Commercial Code (UCC). This Agreement is incorporated by this reference and becomes a part of SunWest Federal Credit Union's Electronic Funds Transfer Disclosure and Agreement effective April 1st, 2002. All other terms and conditions of your Electronic Funds Transfer Disclosure and Agreement, as amended, remain in force.

Description of Service
You may use this Bill Payment service to conveniently pay bills directly from your Credit Union checking account. Payments can be made as single or recurring items and are processed on the day of your choosing. Payments can be made to most merchants or individuals.

Unauthorized Usage
Notify us IMMEDIATELY if you believe your password has been lost, stolen or compromised in any way. You may contact us by telephone during business hours at (602) 993-2993 or (866) 897-9378 or use the Email link provided on our web site. Please refer to the Member's Liability for Unauthorized Transfers section of SunWest's Electronic Funds Transfer Regulation E Disclosure for information regarding your limits of liability.

Business Days
For the purpose of these disclosures, our business days are Monday through Friday, excluding Credit Union holidays.

Personal Identification Number
For purposes of this section, the words Personal Identification Number ("PIN") shall also mean "Password". You are required to use a Member Number and PIN combination for access to Online Banking services including Bill Payment. The PIN is required for security purposes in connection with the authentication of transfers and payments that you initiate. Your PIN is confidential and should NOT be disclosed to others or recorded on documentation or records located on or around your personal computer. You are responsible for the proper safekeeping of your PIN. You agree not to disclose or otherwise make your PIN available to anyone not authorized to sign on your accounts. If you authorize anyone to use your PIN, that authority shall continue until you specifically revoke such authority by changing the PIN or by notifying the Credit Union and obtaining a replacement PIN. You understand that if you reveal your PIN to anyone, or request that the Credit Union issue a PIN to anyone else, you have authorized that individual to transfer and withdraw funds from any of your accounts which can be accessed by the PIN, regardless of whether that person is authorized to transfer or withdraw funds from the account(s) by any means other than by use of Online Banking services. If you fail to maintain security of your PIN and the Credit Union suffers a loss, we reserve the right to terminate Bill Payment and/or Online Banking services to you under this Agreement and Disclosure as well as other Credit Union deposit and loan services. Users of the Online Banking service should utilize such other PIN protection precautions as may be appropriate under any particular set of circumstances to ensure proper security over system access and access to account and transaction information and funds transfer capabilities. Online Banking provides the capability for you to change your PIN. To help safeguard your security, you should change your PIN frequently. If you forget your PIN or your system access is disabled due to the use of an incorrect PIN, you must contact a Credit Union Representative to have a temporary PIN issued to you. Contact the Information Center at (602) 866-1100, or Toll Free at (866) 897-9378 (Outside Maricopa County.) We reserve the right to require written re-application for a new/ replacement PIN.

Our Limits of Liability
If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we may be liable for your losses and damages. However, there are some exceptions. We will NOT be liable, for example, if:

In addition, the Credit Union will also have no liability whatsoever for failure to complete a payment or transfer you initiate or attempt to initiate through Online Banking under any of the following circumstances:

Bill Payment Costs
Effective October 1st, 2006 SunWest will waive the monthly and per item fees associated with the use of the Bill Payment service. You may incur insufficient funds and stop payment fees. Following is a list of the current fees for the Bill Payment service.

These fees are subject to change from time to time. We will notify you to the best of our efforts at least 30 days prior to changes in the fee schedule.

You authorize us to effect automatic payment from one of your accounts by electronic, paper or other means. In the event we are unable to process a transaction, (if, for example, there are insufficient funds in your designated accounts) the transaction will result in a "failed Payment and/or Transfer". In such event, we may process the transaction and charge your account the total cost of the transaction, including any service charges. We may process the transaction even if such transaction brings your account into a negative balance or over limit in your line of credit accounts. In the event of repetitive Failed Payment and/or Transfer, we reserve the right to suspend your use of the Bill Payment service. This suspension may be without prior notice to you. If your usage is suspended, transactions which were previously initiated may continue to be processed unless canceled. Suspension and collection of any amounts owed will be handled by a Third Party Service Provider and all inquiries and correspondence relating thereto should be directed to them. Termination of Bill Payment Service
You may terminate your Bill Payment service at any time by providing written notice to the Credit Union and immediately discontinuing use of the service. Please include your name, member number, daytime phone number, and mail your request to: SunWest Federal Credit Union, 11839 N 28th Dr, Phoenix AZ 85029-3313. Your request will be processed within 48 hours of receipt. Prior to submitting your termination request be sure to cancel all outstanding payment orders. YOU ARE RESPONSIBLE FOR ALL OBLIGATIONS YOU HAVE SCHEDULED PRIOR TO TERMINATION AND FOR ALL OTHER FEES INCURRED. Applicable fees will be assessed for the month in which you have terminated the service.

If you do not utilize Online Banking or the Bill Payment service (by not logging on to the service) for a period of three consecutive months, your access to the service may automatically be deactivated. If this occurs and you wish to reactivate your Online Banking and/or Bill Payment services, you may re-enroll to re-activate your access. We reserve the right to require written reapplication before we reactivate your Online Banking system access. The Credit Union reserves the right to terminate this Agreement with or without cause.

Transaction Limitations
Tax payments and court ordered payments cannot be made using this Bill Payment service. Additionally, payments to any foreign (non U.S.) addresses are prohibited. Single payments may not be made for an amount greater than $9,999.00.

Payment Scheduling
It is important that you take into consideration what method of bill payment will be used when scheduling bill payments to ensure payment deadlines are met. If the payee accepts electronic bill payment, the payment may take up to four business days to process. If the payee does not accept electronic bill payment, the payment will be sent in a check form, and may take up to ten business days to process. Scheduled payments will be debited from your account within 1-2 business days from the scheduled processing date.

Service and Support
To offer this Bill Payment service, SunWest contracts through one or more Third Party Service Providers. Although we have performed a great deal of due diligence in choosing our service provider(s), you understand that this service is not provided directly from the Credit Union. You also understand that the level of service provided by these third party companies may not be consistent with the level of service you have come to expect from the Credit Union itself.
